Terms of Service
Effective Date: September 3, 2026
These Terms of Service ("Terms") govern your use of BabelBot, a Discord bot that provides real-time message translation services ("Service"). By installing, enabling, or using BabelBot, you agree to be bound by these Terms. If you do not agree, do not use BabelBot.
Suurd Digital provides the Service under the trade name BabelBot.

1. Service Description
BabelBot provides:
Except for the Founder Access continuity rights in Section 5.5, the Service is provided on an "as is" basis. We may change features, pricing, and availability as described in Section 12.
BabelBot depends on Discord, Discord APIs, bot permissions, gateway events, OAuth access, and third-party translation, payment, hosting, and infrastructure providers. Changes, outages, limits, or policy decisions by those providers may affect the Service.
- Real-time automatic language detection and message translation
- Server configuration and management via the BabelBot dashboard and limited Discord shortcuts
- Free and premium tiers with different usage limits and features (see pricing page for current details)
2. Eligibility & Authorization
- You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use BabelBot.
- Discord server administrators authorize BabelBot installation and accept these Terms on behalf of their server. You represent that you have the authority to bind your server to these Terms.
- You agree to comply with Discord's Terms of Service and Community Guidelines.
- You agree to inform your server members that BabelBot processes messages for translation and direct them to our Privacy Policy.
3. Acceptable Use
You agree not to use BabelBot to:
- Violate any applicable law, regulation, or third-party right
- Violate Discord's Terms of Service, Community Guidelines, or policies (including hateful conduct, harassment, NSFW content policies, etc.)
- Engage in abuse, harassment, discrimination, hate speech, or targeted attacks against individuals or groups
- Distribute spam, malware, phishing attempts, or deceptive content via the Service
- Circumvent rate limits, payment systems, fraud detection, or security controls
- Reverse engineer, decompile, or attempt to extract BabelBot's models, logic, or infrastructure, except as permitted by the Founder Access continuity license in Section 5.5
- Translate content for the purpose of evading moderation filters, automated safety systems, or policy enforcement
- Engage in scraping, data harvesting, or automated access to the Service beyond normal use
- Resell, sublicense, white-label, or provide BabelBot as part of a competing service without written authorization. Normal use of BabelBot by commercial Discord servers under a valid free or paid plan is allowed.
Violations may result in immediate suspension or termination of service and potential legal action.
4. Data & Privacy
Your use of BabelBot involves the processing of server data and user information. See our Privacy Policy for details on what data we collect, how we use it, retention periods, your rights, and third-party processors.
The Privacy Policy is provided for transparency and explains how we process personal data. It is not used as a general consent form; where consent is legally required, we will request it separately.
5. Pricing, Billing & Payment
5.1 Free Tier
The free tier includes unlimited text translation. Free tier AI quotas, feature restrictions, and media or higher-volume plan limits are displayed on the pricing page and in the dashboard and may change at our discretion.
5.2 Premium Plans
Premium plans (Pro, Ultra, Founder Access) unlock higher limits and additional features. Pricing is displayed in the dashboard billing portal before purchase.
- Monthly Subscriptions: Billed monthly on a recurring basis. You can cancel anytime via the billing portal; cancellation takes effect at the end of the current billing cycle.
- Founder Access: A one-time payment grants Founder Access to one Discord server at a time. Hosted access continues while BabelBot operates the Service, unless we validly terminate the entitlement under these Terms. Section 5.5 applies if we permanently discontinue the hosted Service. Founder Access is non-refundable except as described in Section 5.4 or as required by law.
5.3 Payment Processing
All payments are processed by Polar.sh. You agree to Polar's terms, privacy policy, and payment terms. You are responsible for providing accurate payment information. You are responsible for any taxes, duties, or other charges related to your purchase. Payments are non-refundable except as expressly provided in Section 5.4 or required by law.
5.4 Refund Policy
Because the Service provides immediate digital access, refunds are generally not available after access begins, except where required by consumer law. We also offer a limited refund window for new purchases. An EU consumer normally has a statutory 14-day withdrawal right for a distance service contract. If you request immediate service and then withdraw, we may charge the proportionate amount that applicable law permits. The right ends early only after full performance when the legal consent and acknowledgment requirements are met. This does not limit mandatory consumer rights.
- 7-Day Refund Window: Refunds may be issued within 7 days of purchase if your server has used fewer than 100 translations total and the refund request is submitted within the window.
- Other Refund Requests: Contact support at [email protected] for consideration of refund requests outside the 7-day window. Refunds are reviewed on a case-by-case basis and are not guaranteed.
Abuse of our voluntary refund policy may result in refund denial and account suspension. A good-faith exercise of a statutory withdrawal, conformity, refund, or other mandatory right is not refund abuse.
5.5 Founder Access Continuity
Founder Access combines hosted access with a shutdown fallback. Hosted access continues while BabelBot operates the Service. If "Permanent Discontinuation" occurs, the continuity rights in this Section apply.
5.5.1 Permanent Discontinuation
"Core Service" means BabelBot's automatic Discord text translation and the settings needed to operate it. "Permanent Discontinuation" occurs if we announce that the Core Service or Founder Access will permanently end for eligible holders. It also occurs if the Core Service is unavailable to all or substantially all eligible holders for 90 consecutive days and we do not restore it. Temporary maintenance, an isolated outage, removal of one feature, or suspension of one customer is not Permanent Discontinuation.
5.5.2 Successor Service
A sale, transfer, reorganization, or rebranding of BabelBot is not Permanent Discontinuation if a successor provides a "Successor Service." The successor must provide materially equivalent Founder Access without another purchase or a recurring fee. It must also accept the duties in this Section in writing. If it does not, we will provide the Self-Hosting Package before the transfer or before it changes Founder Access.
5.5.3 Eligible Founder Customers
For this Section, "Founder Access" includes the same one-time, one-server entitlement that BabelBot previously sold or granted as "Lifetime" or "Lifetime Access." These names refer to the same entitlement. An "Active Founder Entitlement" is a valid Founder Access or historical Lifetime purchase or grant. An entitlement is not active if its full purchase price was refunded. It is also not active if its purchase was successfully charged back and remains unpaid. The same applies if the purchase or grant was obtained through fraud. A valid termination for material breach before the Eligibility Date can also make it inactive. Removing BabelBot, suspending hosted access, transferring the entitlement, or leaving it temporarily unassigned does not end it. Eligibility follows the entitlement and does not extend to every former holder or server administrator. We will use available billing, grant, transfer, assignment, and Discord ownership records to identify the eligible holder. If no holder is recorded, the verified current owner of the assigned Discord server can qualify. If the entitlement is unassigned, a claimant must provide reasonable evidence of the purchase, grant, or entitlement history. A missing modern customer record does not by itself make a valid legacy entitlement ineligible. We can delay delivery only to claimants involved in a genuine conflicting claim. The delay cannot exceed the reasonable time needed to resolve that conflict. We cannot suspend or terminate an entitlement to avoid this Section. Except in cases of fraud or an immediate legal or safety concern, we must first give notice and a reasonable opportunity to cure a breach. The "Eligibility Date" is the earliest of our discontinuation notice, the shutdown date, or the start of the 90-day outage in Section 5.5.1.
5.5.4 Self-Hosting Package
BabelBot does not maintain a separate self-hosted edition while the hosted Service operates. If Permanent Discontinuation becomes likely or occurs, we will prepare a "Self-Hosting Package." The package will use the latest stable version of the source code that we own or can distribute. It will include the core bot, its settings interface, database schemas, migrations, dependency files, non-secret templates, and setup instructions. At delivery, the package and its disclosed obtainable dependencies will be capable of operating the Core Service. We will include each Founder Access feature that we have the right to distribute.
5.5.5 Continuity License
When we provide the Self-Hosting Package, we grant the eligible holder a perpetual, worldwide, royalty-free, non-exclusive license to use and modify it. The license is non-transferable and irrevocable, except after a material breach of its conditions. The holder can move the self-hosted instance between servers they manage but can operate it for only one server at a time. A contractor can help operate the instance if the contractor keeps the code confidential and uses it only for the holder. The holder cannot publish, redistribute, sublicense, resell, or white-label the package. The holder cannot use it to provide a competing hosted service. This license does not grant rights to the BabelBot name, logo, domains, or other trademarks.
5.5.6 Excluded Items and External Services
The package will not include production credentials, private keys, API keys, OAuth tokens, customer data, production databases, logs, provider accounts, or payment systems. It will not include internal administration tools or third-party material that we cannot distribute. Open-source dependencies remain subject to their own licenses. We will identify any omitted component that affects a Founder Access feature. Where an obtainable substitute exists, we will document how to connect it. The holder must obtain and pay for hosting, a Discord application, databases, translation-provider accounts, and other required services.
5.5.7 Notice and Delivery
For a planned shutdown, we will provide the package before the hosted Service ends. We will give at least 60 days' notice by email to the recorded contact and through our website or dashboard. If an unexpected shutdown prevents advance delivery, we will provide the package within 60 days after Permanent Discontinuation. When it is ready, we will notify eligible holders through the same available channels. We will deliver it through a private repository or an authenticated archive. We will keep it available for at least 12 months. The continuity license remains perpetual after that download period. We can require proof of identity and entitlement before delivery. Financial difficulty or a change in business strategy does not cancel this duty. A law or court order can prevent distribution of a specific part. In that case, we will identify that part and distribute all other permitted parts.
5.5.8 Operation, Support, and Security
We will test the documented installation before we release the package. We do not guarantee that each feature will continue to work after Discord or another provider changes or ends its service. The package does not include continued hosting, maintenance, support, compatibility work, or security updates. The holder is responsible for security, backups, lawful data processing, and compliance with third-party terms.
5.5.9 Server Configuration
Each notice under Section 5.5.7 will explain how to request an export of the assigned server's BabelBot settings. The requester must have current authority to manage that server. The request deadline will be at least 60 days after the notice. The export will not contain message history, credentials, another server's information, or personal data that we cannot disclose.
5.5.10 Mandatory Rights
These continuity rights add to any rights available under applicable law. The Self-Hosting Package is not the holder's only remedy. This Section does not limit a right or remedy that the law does not permit us to limit.
5.5.11 Historical Entitlements and Protection from Later Changes
This Section applies to every Active Founder Entitlement purchased or granted before, on, or after the effective date shown at the top of these Terms. It applies whether our records or earlier communications call it Founder Access, Lifetime, or Lifetime Access. No new purchase or fee is required. After a permitted transfer, the rights remain with the continuing entitlement and its eligible holder. A former holder or previously assigned server does not receive a separate entitlement or continuity license. This update adds protection and does not reduce a stronger right in an existing Founder Access or historical Lifetime agreement. We will not remove or materially reduce these rights without the eligible holder's express agreement.
6. Fair Use & Service Limits
To ensure service quality and fairness across all users, each premium tier may be subject to both the translation limits shown on the pricing page or dashboard and a fair-use limit of 1,000,000 characters per month per guild.
If usage materially exceeds this limit, we may:
- Temporarily rate-limit or suspend access
- Request you upgrade to an enterprise tier (if available)
- Contact you to discuss your usage and potential solutions
Repeated violations of fair-use limits may result in account suspension or termination.
7. Intellectual Property
- BabelBot IP: You acknowledge that BabelBot, including its code, algorithms, UI, and design, is owned by us and protected by copyright, trademark, and trade secret laws.
- Hosted Service License: We grant you a non-exclusive, non-transferable, revocable license to use the hosted Service solely for translating messages in Discord servers you have authority over. The separate Founder Access continuity license in Section 5.5 survives Permanent Discontinuation under its stated conditions.
- Your Content: You retain all rights to messages and data you post in Discord. By using BabelBot, you grant us a limited license to process your messages and server data as described in the Privacy Policy and these Terms.
- Feedback: Any feedback, suggestions, or improvements you provide to us may be used at our sole discretion without compensation or attribution.
8. Termination & Suspension
8.1 Termination by You
You may remove BabelBot from your server at any time via Discord server settings. After removal, we stop processing new messages or content to provide the Service. We may continue to process billing records, configuration data, and other records as described in the Privacy Policy.
8.2 Suspension & Termination by Us
We may suspend access if you violate these Terms or Discord policies, or if your use creates a security, legal, or material operational risk. We may terminate access for a material breach, fraud, material abuse of our voluntary refund policy, or other material bad-faith conduct. Except in cases of fraud or an immediate legal or safety concern, we will give notice and a reasonable opportunity to cure a breach before termination.
8.3 Effects of Termination
After termination, the hosted Service license ends. Suspension or termination does not remove a Founder Access delivery right or continuity license except when Section 5.5.3 expressly makes the holder ineligible. We retain server configuration, usage data, and billing records as described in the Privacy Policy. Paid subscriptions are non-refundable unless these Terms or applicable law require a refund. The liability, indemnification, governing law, and other provisions that must remain effective will survive termination.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABELBOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We specifically disclaim all implied warranties, including:
For consumers, this Section does not exclude mandatory rights concerning supply, functionality, continuity, security, updates, or remedies for a non-conforming digital service.
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, completeness, or reliability of translations
We make no warranty that:
- The Service will be uninterrupted, timely, secure, or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Translations will be accurate or suitable for your purposes
- The Service will meet your expectations or requirements
Some jurisdictions do not allow disclaimers of implied warranties. In such cases, the above disclaimer applies only to the extent permitted by law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR:
- Indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, lost revenue, lost data, or loss of use)
- Any damage, loss, or injury that results from translation errors, inaccuracies, or failures
- Service interruptions, downtime, or unavailability
- Unauthorized access to or alteration of your data
- Third-party actions, content, or conduct
- Any other losses arising out of or in connection with these Terms or the Service
EXCEPT AS PROVIDED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM. IF YOU HAVE PAID NOTHING, LIABILITY IS LIMITED TO $100 USD.
These exclusions and the 12-month payment limit do not apply to a claim that we failed to provide the Self-Hosting Package under Section 5.5. This exception applies regardless of the theory of liability.
This Section does not limit a right or remedy that the law does not permit us to limit. Some jurisdictions do not allow certain exclusions or limitations of liability. In those cases, the exclusions and limitations above apply only to the extent permitted by law.
11. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and successors from third-party claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, directly caused by your intentional or negligent conduct involving:
- Your material breach of these Terms
- Your material breach of Discord's Terms of Service while using BabelBot
- Your violation of an applicable law or third-party right
This obligation does not apply to the extent a claim arises from our conduct or from content or conduct outside your control. It also does not apply where mandatory consumer law prevents it.
12. Modifications to the Service & Terms
12.1 Service Changes
Subject to Section 5.5, we may change the Service for a valid reason stated in these Terms. Valid reasons include Discord API changes, provider changes, security concerns, cost increases, legal requirements, and operational needs. We will not charge an additional fee for the change. We will explain each material change in clear language. If a change has more than a minor negative effect on access or use, we will give reasonable advance notice by email or another durable medium. Where applicable, that notice will explain the right to end the contract without charge within 30 days. This right does not apply if we keep a conforming, unchanged version available without additional cost. Mandatory consumer rights remain unaffected.
12.2 Changes to These Terms
We may update these Terms from time to time. For material changes, we will:
- Post the updated Terms on this page with a new effective date
- Announce significant changes through our official support channels and Discord server
- If required, request your acceptance of new Terms before continued use
Continued use of BabelBot 7 days after we post updated Terms constitutes acceptance only where applicable law permits this. We will request express agreement for a materially adverse contract change when required. Section 5.5 explains the additional consent required to reduce continuity rights for an existing Founder Access entitlement.
13. Governing Law & Dispute Resolution
13.1 Governing Law
These Terms and your use of BabelBot are governed by the laws of the Netherlands, without regard to conflict of law principles.
13.2 Dispute Resolution
If a dispute arises, contact us first at [email protected] to seek an informal solution. If that fails, legal proceedings will take place in the Netherlands unless mandatory consumer law permits another court. Consumers keep any right to bring or defend proceedings in the courts where they live.
13.3 No Class Actions
To the extent permitted by law, disputes must be resolved on an individual basis. This Section does not restrict a mandatory right to participate in collective redress or another collective proceeding.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, will be severed. The remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, our Privacy Policy, and the policies referenced here form the agreement between you and us for the Service. They replace earlier communications unless an earlier statement or agreement gives an existing Founder Access holder a stronger right that remains binding. The Privacy Policy controls a conflict about data handling. Section 5.5 controls any conflict about Founder Access continuity. These Terms control other conflicts.
